O advogado Franco Paulino dos Santos Martyres entrou com um pedido de habeas corpus em favor de Aquino Jacinto dos Santos, preso desde 26 de junho de 1961, suspeito de matar seu sobrinho, Mário Jorge, cujo corpo foi encontrado perto de sua casa. O advogado alegou que a prisão era ilegal, pois não houve flagrante nem ordem judicial. O juiz Joel Quaresma de Moura solicitou informações urgentes à delegacia e à cadeia pública sobre a prisão para decidir sobre o caso.
